2. CALL TO ORDER - The meeting of the City Council was called to order by Mayor Bob Woerner at 7:00 pm, held in person at 1016 S. Livermore Avenue and remotely using Zoom and YouTube.

3.1 Proclamation declaring October 2022 as Hindu American Awareness and Appreciation Month presented to Rajeev Singh of the Hindu American Foundation.

Recommendation: Staff recommends City Council declare October 2022 as Hindu American Awareness and Appreciation Month.

Recommendation: Staff recommends City Council accept the update.

5. CONSENT CALENDAR

ON THE MOTION OF CM MUNRO, SECONDED BY CM CARLING, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR.

5.1 Approval of draft minutes - May 31, 2022 Special Meeting, September 12, 2022 Regular Meeting, and September 27, 2022 Special Meeting.

Recommendation: Staff recommended the City Council approve the draft minutes.

5.2 Resolution 2022-164 authorizing the execution of an agreement with Insight Public Sector for the replacement of the City's primary data storage system in an amount not-to-exceed $142,000.

Recommendation: Staff recommended the City Council adopt a resolution authorizing the execution of an agreement with Insight Public Sector for the replacement of the City's primary data storage system in an amount not-to-exceed $142,000.

5.3 Resolution 2022-165 Resolution authorizing the City Manager to enter into a Memorandum of Understanding with the City of Pleasanton for joint Tri-Valley Cities legislative advocacy services in a not-to-exceed contract amount of $150,000 for a term of five years.

Recommendation: Staff recommended City Council adopt a resolution authorizing the City Manager to enter into a Memorandum of Understanding with the City of Pleasanton for joint Tri-Valley Cities legislative advocacy services through consultant Townsend Public Affairs in a not-to-exceed contract amount of $150,000 for a total term of five years. The City of Pleasanton is the fiduciary agent.

5.4 Resolution 2022-166 approving amendments to the City of Livermore Salary Plan to reflect previous agreements and a classification study.

Recommendation: Staff recommended the City Council adopt a resolution approving the City of Livermore Salary Plan as of October 10, 2022, in accordance with California Code of Regulations, Title 2, Section 570.5.

5.5 Resolution 2022-167 reauthorizing remote or hybrid teleconference meetings for City of Livermore's legislative bodies in accordance with Assembly Bill 361.

Recommendation: Staff recommends City Council adopt a resolution reauthorizing remote or hybrid teleconference meetings for City of Livermore's legislative bodies in accordance with Assembly Bill 361.

6. PUBLIC HEARINGS - NONE

6.1 THIS PREVIOUSLY NOTICED ITEM HAS BEEN CONTINUED TO THE OCTOBER 24, 2022 CITY COUNCIL MEETING

Hearing to approve an Amended and Restated Disposition and Development Agreement with Red Bear Property Management, Inc. for development of downtown commercial uses, authorizing the City Manager to execute the agreement and all other necessary documents to implement that agreement, and to conform the Stockmen's Park easement to this project and others on the park site.

6.2 Hearing to receive and consider protests related to the annual fire hazard abatement program and confirm the 2022 weed abatement assessments for collection on the County Assessor tax roll.

Recommendation: Staff recommends City Council consider all protests, and if Council finds appropriate, adopt a resolution overruling protests and confirming the 2022 weed abatement assessments and direct staff to file a certified copy of the assessment report with the County Auditor.

ON THE MOTION OF MAYOR WOERNER, SECONDED CM MUNRO AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION AND DIRECTED STAFF TO REMOVE THE PROPERTY LOCATED ON CONCANNON BLVD FROM THE ASSESSMENT LIST:

Resolution 2022-168 overruled protests and confirmed the 2022 weed abatement assessments and directed staff to file a certified copy of the assessment report with the County Auditor for the property located on Marylin Avenue.

7. MATTERS FOR CONSIDERATION

7.1 Discussion and direction regarding the 2022 Community Survey including selection of customized questions.

Recommendation: Staff recommended the City Council provide direction regarding the inclusion of specific, closed-end policy questions in the upcoming National Community Survey TM, which is scheduled for data collection during November through December 2022.

CITY COUNCIL RECEIVED THE PRESENTATION AND APPROVED THE QUESTION CATEGORIES - GENERAL PLAN UPDATE, CLIMATE ACTION, AND COMMUNITY ENGAGEMENT.

7.2 Information requested regarding reproductive rights.

Recommendation: Staff recommends City Council receive information requested regarding reproductive rights.

CITY COUNCIL RECEIVED THE PRESENTATION AND DIRECTED STAFF TO CHECK IN WITH COMMUNITY PARTNERS TO FIND OUT IF THEY ARE SEEING ADDITIONAL NEEDS IN THE COMMUNITY REGARDING THE REPRODUCTIVE RIGHTS.

Livermore Airport Open House CM Kiick and CM Munro noted their attendance at the event on October 1, 2022.

Tri-Valley Cities Council Meeting CM Carling and CM Munro noted their attendance at meeting.

Livermore Police Department Swearing-In VM Bonanno and CM Munro noted their attendance at the event on September 29, 2022.

Taste of Africa CM Munro noted her attendance at the event on October 1, 2022.

Filipino Barrio Fiesta CM Munro noted her attendance at the event on October 2, 2022.

Art Walk CM Munro noted her attendance at the event on October 8, 2022.

Indigenous Peoples Day CM Munro recognized October 10 as indigenous people's day.

Climate Action Subcommittee VM Bonanno and CM Carling noted their attendance at subcommittee meetings.

Pride Month VM Bonanno recognized October as Pride Month and invited the community to participate in events happening throughout the month.
