CALL TO ORDER - The Closed Session of the City Council was called to order by Mayor Bob Woerner at 6:30 pm, held via teleconference using Zoom and YouTube.

ROLL CALL - Present: Mayor Bob Woerner, Vice Mayor Trish Munro, and Council Members Regina Bonanno, Robert W. Carling and Brittni Kiick.

Mayor Woerner opened the public hearing.

REGULAR MEETING

1. CALL TO ORDER / PLEDGE OF ALLEGIANCE - The meeting of the City Council was called to order by Mayor Bob Woerner at 7:00 pm, held via teleconference using Zoom and YouTube.

ROLL CALL - Present: Mayor Bob Woerner, Vice Mayor Trish Munro and Council Members Regina Bonanno, Robert W. Carling, and Brittni Kiick.

City Attorney Jason Alcala said there was no reportable action.

2. PROCLAMATIONS AND PRESENTATIONS

2.1 Proclamation declaring April 16-25, 2021 as Earthweek Tri-Valley 2021.

Recommendation: Staff recommended City Council declare April 16-25, 2021, Earthweek Tri-Valley 2021.

Mayor Woerner presented the proclamation to Ann Brown with Tri-Valley Citizen's Climate Education.

2.2 Proclamation declaring April 18-24, 2021, as National Crime Victims' Rights Week

Recommendation: Staff recommended City Council declare April 18-April 24, 2021, as National Crime Victims' Rights Week.

Mayor Woerner presented the proclamation to Michelle Joya with Alameda County District Attorney's Office.

2.3 Confirmation of Advisory Body Appointments to Airport Commission, Beautification Committee, and Community Asset Management Program (CAMP) Outreach.

Recommendation: The City Council Subcommittee on Advisory Bodies recommended the City Council confirm the advisory body appointments and direct the City Clerk to schedule individual meetings with the new members to administer the oath of office.

Airport Commission

Appointment of Victoria Schellenberger to an unexpired term ending November 1, 2024.

Beautification Committee

Appointment of Saundra Lormand to an unexpired term ending June 1, 2021.

Appointment of Kyra Pervere to an unexpired term ending June 1, 2023.

Community Asset Management Program (CAMP) Outreach

Appointment of Jill Farrell to an unexpired term ending December 31, 2021.

City Clerk Marie Weber presented the staff report.

ON THE MOTION OF VM MUNRO, SECONDED BY CM BONANNO AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL CONFIRMED THE APPOINTMENTS.

3. CITIZENS FORUM

Carrie Olds, Spectrum Community Services, provided an update of the Meals on Wheels program.

Kathy Pedrini asked the City Council to consider the negative impacts of Kaiser Air expanding the airport.

Melissa Huntsman spoke in support of the comments made by Mrs. Pedrini and spoke against an airport expansion.

4. CONSENT CALENDAR

Item 4.1 was removed from the Consent Calendar for separate discussion and action.

Mayor Woerner opened the public comment.

There were no speakers and the hearing was closed.

ON THE MOTION OF VM MUNRO, SECONDED BY CM KIICK, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR WITH THE EXCEPTION OF ITEM 41.

ON THE MOTION OF VM MUNRO, SECONDED BY CM CARLING, AND CARRIED ON A 3-0 VOTE WITH COUNCIL MEMBERS BONANNO AND KIICK ABSTAINING, THE CITY COUNCIL APPROVED CONSENT CALENDAR ITEMS 4.1.

4.1 Approval of draft minutes - November 9, 2020 City Council Regular Meeting and November 16, 2020 City Council Special Meeting.

Recommendation: Staff recommended the City Council approve the draft minutes.

4.2 Approval of draft minutes - March 29, 2021 City Council Special Meeting.

Recommendation: Staff recommended the City Council approve the draft minutes.

4.3 Resolution 2021-045 authorizing the City Manager to execute the second amendment to the agreement with East Bay Municipal Consulting for on-call plan check and development engineering review services, extending the contract term through December 31, 2021, and increasing the not-to-exceed amount from $300,000 to $360,000.

4.4 Resolution 2021-046 directing the City Engineer to file the Annual Engineer's Report for the City's Landscape Maintenance Districts.

Recommendation: Staff recommended the City Council adopt a resolution directing the City Engineer to file the Annual Engineer's Report for the City's Landscape Maintenance Districts.

5.

5. PUBLIC HEARINGS

5.1 Hearing to consider the Historic Resources Update project. The project would: 1. Amend the Livermore Development Code to update and clarify the City's Certificate of Appropriateness standards and remove the Historic Overlay zoning district standards; 2. Amend the Zoning Map to remove the Historic Overlay zoning districts; 3. Amend the Downtown Specific Plan to update and clarify Downtown historic preservation policies; 4. Update the citywide Historic Resources Inventory to analyze all city parcels and replace the Historic Overlay districts; and

5. Prepare a citywide Historic Context Statement to identify Livermore's historic themes and property types.

Recommendation: The Planning Commission, Historic Preservation Commission, and staff recommended the City Council:

1. Adopt a resolution finding the project is exempt under the California Environmental Quality Act;

2. Adopt a resolution approving Specific Plan Amendment 20-002, Policy Proposal 20-001, and Policy Proposal 20-002;

3. Introduce an ordinance adopting Development Code Amendment 20-005 and Zoning Map Amendment 20-003; and

4. Instruct staff to file a Notice of Exemption, in accordance with the provisions of the California Environmental Quality Act.

The project would adopt a new citywide historic context statement and historic resources inventory, and would authorize changes to the Development Code, Zoning Map, and Downtown Specific Plan in order to better preserve Livermore's rich heritage and unique character, consistent with the General Plan.

Assistant Planner Jake Potter presented the staff report.

Mayor Woerner opened the public hearing.

In response to questions from CM Bonanno, Mr. Potter stated that the best practice is to update the City's Historic Resources every few years.

In response to questions from CM Bonanno, Mr. Potter stated that only properties 50 years and older were assessed. Remaining properties would be evaluated after they turned 50 years old. He also confirmed that the County has a Commission managing historic resources.

In response to questions from CM Bonanno, Mr. Potter confirmed that this project focuses on historical property and the Livermore Historic Society focuses on historic items that are not physical property.

In response to questions from VM Munro, Mr, Potter explained that the age to qualify for consideration as a historical resource is determined by federal laws.

In response to questions from Mayor Woerner, Mr. Potter confirmed that the City doesn't have any property under 50 years old that meets the requirements to be considered historically significant.

Consultant Amanda Yoder confirmed that buildings under 50 years of age could be deemed historical if an explanation of why the property is exceptionally significant could be provided.

ON THE MOTION OF CM CARLING, SECONDED BY CM KIICK AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTIONS AND INTRODUCED THE FOLLOWING ORDINANCE:

Resolution 2021-047 adopting an exemption in accordance with the California Environmental Quality Act.

Resolution 2021-048 approving Downtown Specific Plan Amendment (SPPA) 20-002; Policy Proposal (POL) 20-001; and Policy Proposal (POL) 20-002 for the Historic Resources Update Project.

Ordinance introduced amending Livermore Development Code Chapter 4.07 (Historic Preservation Overlays) and Chapter 9.02 (Certificates of Appropriateness) and amending the Zoning District Map of the City of Livermore for the Historic Resources Update Project.

6. MATTERS FOR CONSIDERATION

6.1 Oral report from the Director of Emergency Services regarding the COVID-19 emergency, its impacts, and the governmental operations in response to that emergency, as well as discussion and direction regarding the City's emergency operations in response to that emergency.

Recommendation: An oral report will be given at the meeting.

Director of Emergency Services Marc Roberts presented the report.

In response to questions from CM Carling, Mr. Roberts confirmed that $7,500 was the maximum for the commercial rent abatement assistance and that some availability for applications still existed.

In response to questions from CM Bonanno, Mr. Roberts stated that there is no expiration for the e-gift program and the City expected funds to be exhausted in the next 30 days.

In response to questions from CM Bonanno, Mr. Roberts stated that staff expected the County data for the overall and lowest health population index numbers to be reflective of the numbers in Livermore.

In response to questions from CM Bonanno, Mr. Roberts stated that mobile vaccinations have focused on the homeless population and other mobile vaccinations are being set up by the County of Alameda for home bound residents.

The City Council requested staff put information on the website detailing how residents without internet access can schedule an appointment to be vaccinated.

Mr. Roberts stated that the City is working with non-profit partners and workstations at the library to provide residents with resources to schedule vaccination appointments.

6.2 Discussion and direction regarding a resolution denouncing xenophobia and anti-Asian racism arising due to fears of the COVID-19 pandemic and affirming the City Council's commitment to the well-being and safety of Asian Pacific Islander communities and reaffirming its support of a culture of welcome, inclusion, and respect.

Recommendation: Staff recommended the City Council consider adoption of a resolution denouncing xenophobia and anti-Asian racism arising due to fears of the COVID-19 pandemic and affirming its commitment to the well-being and safety of Asian Pacific Islander communities and reaffirming its support of a culture of welcome, inclusion, and respect.

Deputy City Manager Christine Martin presented the staff report.

ON THE MOTION OF CM KIICK, SECONDED BY CM BONANNO AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2021-049 denouncing xenophobia and anti-Asian racism arising due to fears of the COVID-19 pandemic and affirming the City of Livermore's commitment to the well-being and safety of Asian and Pacific Islander communities and reaffirming its support of a culture of welcome, inclusion, and respect for everyone.

7. COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED

7.1 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Council Members.

Livermore Amador Valley Transit Authority (LAVTA) CM Kiick noted that she connected LAVTA staff with the executive director of Goodness Village put a bus stop near Goodness Village.

Goodness Village CM Kiick, CM Carling, and VM Munro noted they took a tour of Goodness Village with the executive director.

Equity and Inclusion CM Carling and VM Munro noted their attendance at meetings every Tuesday and Thursday.

League of California Cities CM Carling and VM Munro noted their attendance at the meeting on March 23, 2021.

Zone 7 CM Carling noted his attendance at the Water 101 training.

Climate Change Webinar CM Carling noted his attendance at the webinar.

Livermore Downtown, Inc. CM Bonanno noted her attendance at the meeting on March 16, 2021.

Chamber of Commerce CM Bonanno and Mayor Woerner noted their attendance at the Chamber Business Alliance meeting on April 7, 2021.

Livermore Climate Scientists CM Bonanno noted that the Climate Action Plan Advisory Committee and the lab scientists are working together to review data and make recommendations for the Climate Action Plan.

Livermore Cultural Arts Council VM Munro noted her attendance at the meeting on April 7, 2021.

Tri-Valley City Mayor's Meeting Mayor Woerner noted his attendance on March 29, 2021.

Local Agency Formation Commission Mayor Woerner noted that the board recently approved the plans for the new Chick-fil-a location.

Alameda County Transportation Commission Mayor Woerner noted his attendance at the meeting on March 25, 2021 and recommended residents review the agenda to see the significant projects moving forward.
