CALL TO ORDER - The Closed Session of the City Council was called to order by Mayor Bob Woerner at 6:30 pm, held via teleconference using Zoom and YouTube.

ROLL CALL - Present: Mayor Bob Woerner, Vice Mayor Trish Munro, and Council Members Regina Bonanno, Robert W. Carling and Brittni Kiick.

City Attorney Jason Alcala said there was no reportable action.

Mayor Woerner reordered the agenda to conduct the public hearing for item 6.2 at the noticed time of 7:05PM.

Recommendation: Staff recommended the City Council:

1. Receive a report on the redistricting process and permissible criteria to be considered to redraw City Council election district boundaries; and

2. Conduct a public hearing to receive public input on the redistricting process and permissible criteria (including without limitation district boundaries and composition thereof).

City Clerk Marie Weber presented the staff report. Consultants Michael Wagaman with Wagaman Strategies and Jennifer Nentwig with Tripepi Smith provided presentations.

3.1 All-America City Award Presentation

Recommendation: Staff recommended the City Council receive the All-America City award from National Civic League Board Member Barbara Halliday.

Hayward Mayor Barbara Halliday, Livermore Valley Joint Unified School District Superintendent Kelly Bowers, Los Positas College President Dyrell Foster, and CM Carling presented the award to the City. Livermore Management Analyst Stephanie Egidio presented the winners of the All American City Photo Contest.

3.2 Proclamation supporting and welcoming Afghan refugees and the people of Afghanistan

Recommendation: Staff recommended the City Council proclaim Livermore as a City that supports and welcomes Afghan refugees and the people of Afghanistan.

ON THE MOTION OF CM BONANNO, SECONDED BY VM MUNRO, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR.

5.1 Approval of draft minutes - September 27, 2021 City Council Regular Meeting and September 28, 2021 and September 30, 2021 City Council Special Meetings.

Recommendation: Staff recommended the City Council approve the draft minutes.

5.2 Resolution 2021-166 authorizing execution of Task Order No.13 to the Tri-Valley Intergovernmental Reciprocal Services Master Agreement with Zone 7 Water Agency for the Iron Horse Trail Improvements - Isabel Avenue to Murrieta Boulevard, Project No. 2017-24, in an amount not to exceed $245,082.

Recommendation: Staff recommended the City Council adopt a resolution authorizing the City Manager to execute Task Order No. 13 to the Tri-Valley Intergovernmental Reciprocal Services Master Agreement with Zone 7 Water Agency for the Iron Horse Trail- Isabel Avenue to Murrieta Boulevard, Project No. 2017-24, in an amount not to exceed $245,082.

5.3 Resolution 2021-167 authorizing execution of a Purchase Order with Belkorp Ag, LLC. for two replacement tractors, in the not-to-exceed amount of $225,111.

Recommendation: Staff recommended the City Council adopt a resolution authorizing execution of a Purchase Order with Belkorp Ag, LLC. for two replacement tractors, in the not-to-exceed amount of

$225,111.

5.4 Resolution 2021-168 authorizing execution of an agreement with F&V Enterprise, Inc. DBA Tri-Valley Auto Body for on-call vehicle body work and repair services in an amount not-to-exceed

$180,000.

Recommendation: Staff recommended the City Council adopt a resolution authorizing execution of a three-year agreement with F&V Enterprise, Inc. DBA Tri-Valley Auto Body (Tri-Valley) to perform on-call services for vehicle body work and repair services of City vehicles and equipment with an option to extend for one additional two-year term, in an amount not-to-exceed $180,000.

5.5 Resolution 2021-169 approving the Memorandum of Understanding between the City of Livermore and the Association of Livermore Employees.

Recommendation: Staff recommended that the City Council adopt a resolution authorizing the execution of the Memorandum of Understanding (MOU) between the City of Livermore and the Association of Livermore Employees for the term of October 1, 2021 through September 30, 2025.

5.6 Resolution 2021-170 approving the City of Livermore Salary Plan as of October 11, 2021 in accordance with the California Code of Regulations, Title 2, Section 570.5.

Recommendation: Staff recommended that the City Council adopt a resolution approving the City of Livermore Salary Plan as of October 11, 2021 in accordance with the California Code of Regulations, Title 2, Section 570.5.

5.7 Resolution 2021-171 accepting the Livermore Downtown Inc. Annual Report for FY 2020/2021, appropriating an additional $40,000 to the previously budgeted $90,000 for the increased scope of services, and authorizing the execution of a grant agreement with Livermore Downtown Inc. in the amount of $130,000 for services provided to the City and for related operating expenses for FY 2021-22.

Recommendation: Staff recommended the Council adopt a resolution accepting the Livermore Downtown Inc. Annual Report for FY 2020/2021, appropriating an additional $40,000 to the previously budgeted $90,000 for the increased scope of services, and authorizing the execution of a grant agreement with Livermore Downtown Inc. in the amount of $130,000 for services provided to the City and for related operating expenses for FY 2021-22.

6. PUBLIC HEARINGS

6.1 Hearing to receive and consider protests related to the annual fire hazard abatement program and confirm the 2021 weed abatement assessments for collection on the County Assessor tax roll.

Recommendation: Staff recommended City Council consider all protests, and if Council finds appropriate, adopt a resolution overruling protests and confirming the 2021 weed abatement assessments and direct staff to file a certified copy of the assessment report with the County Auditor.

ON THE MOTION OF CM CARLING, SECONDED BY CM KIICK AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2021-172 overruling protests and confirming assessments - fire hazard abatement.

7. MATTERS FOR CONSIDERATION

7.1 Oral report from the Director of Emergency Services regarding the COVID-19 emergency, its impacts, and the governmental operations in response to that emergency, as well as discussion and direction regarding (1) the City's emergency operations in response to that emergency, and (2) regarding a report from the County/City task force on vaccinations.

Recommendation: An oral report was given at the meeting.

THE CITY COUNCIL RECEIVED THE UPDATE AND DIRECTED STAFF TO DISPLAY THE TOTAL POPULATION NUMBER OF VACCINATED RESIDENTS ON THE CITY'S WEBSITE AND ENSURE VACCINATION PERCENTAGES CLARIFY TOTAL POPULATION VACCINATED VERSUS RESIDENTS OVER THE AGE OF 12 WHO HAVE RECEIVED VACCINATIONS.

7.2 Resolution approving the hiring of retired annuitant, Neal Snedecor Jr., Information Technology Manager in accordance with Government Code section 7522.56 of the Public Employees' Retirement Law.

Recommendation: Staff recommended that the City Council adopt a resolution approving the hiring of retired annuitant, Neal Snedecor Jr., Information Technology Manager in accordance with Government Code section 7522.56 of the Public Employees' Retirement Law.

ON THE MOTION OF MAYOR WOERNER, SECONDED BY CM BONANNO AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL ADOPTED THE FOLLOWING RESOLUTION:

Resolution 2021-173 adopting 180-day wait period exception to hire a retiree in accordance with Government Code Sections 7522.56 and 21224.

7.3 Public meeting to receive testimony on the formation of the Livermore Valley Wine Heritage District.

Recommendation: Staff recommended the City Council open the public meeting and receive testimony.

Innovation and Economic Development Director Adam Van de Water presented the staff report.

Recommendation Staff recommended that City Council receive an update on the FY 2021-23 Goals and Priorities and Equity and Inclusion workplan.

8. COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED BY THE CITY MANAGER, CITY ATTORNEY, STAFF, AND COUNCIL MEMBERS

Livermore Amador Valley Transit Authority CM Kiick and CM Bonanno noted their attendance at the October 4, 2021 Board Meeting.

General Plan Committee Recruitment City Council directed staff to do a follow up survey regarding the recruitment to capture best practices and add a question to future applications related to accommodation needs of applicants.

Goodness Village CM Carling noted volunteer time spent on October 2, 2021.

Homeless Liaison Ride-Along CM Carling noted his attendance on a ride-along with homeless liaison officers on October 5, 2021.

Bikes and Brews CM Carling noted his attendance at the fundraiser on October 9, 2021.

Climate Action Subcommittee CM Carling and CM Bonanno noted their attendance at several meetings during the week of October 4, 2021.

LAVTA Electric Bus Fleet City Council requested that the LAVTA Appointee's - CM Kiick and CM Bonanno - work with the City Manager to provide the entire Council the opportunity to give input regarding the upcoming vote.

Afghan Refugee Proclamation City Council directed staff to put resources on the website related to how resident can help support refugees.

Intergovernmental Appointments City Council requested an item be added to the agenda related to criteria that would help council members determine what topics to bring back to the full City Council for discussion.

League of California Cities Annual Conference VM Munro noted her attendance at the conference from September 22nd - September 24th.

POW MIA Flag City Council requested an item be added to a future agenda authorizing the City to fly the flag the week of November 10-17, 2021.
